On 12 August 1789 Thomas Durham donated one acre of land to preacher Thomas Cate [his father-in-law] and eight trustees so they could build the Cain Creek Meeting House which later became known as the Cain Creek Baptist Church. The Will of Thomas Durham Orange County, North Carolina was recorded in Orange County Will Book D, Pages 103 and 104. The Will was Dated: 22 May 1803 and Proved in the August Term 1803. The Will read as follows: In the Name of God Amen I Thomas Durham of the county of Orange & State of North Carolina being very sick and weak but of perfect mind & memory thanks be given unto God Calling unto mind the mortal of my body & Knowing that it is appointed for all men once to die do make and ordain this my last will & Testament that is to say principally first of all -- I give & bequeath my soul into the hand of Almighty God that gave it & my body I recommend to the earth to be buried in a decent Christian burial at the discretion of my executors Nothing doubting but at the general resurrection I Shall receive the same again by the mighty power of God- And as Touching such worldly estate wherewith it has pleased God to bless me in this life I give & Dispose of the same in the following manner & form all my Just debts to be paid First I give & bequeath to my beloved Wife Susey durham all my Household furniture & all the move able property during her natural life her widowhood & at her death to [unreadable] to be sold and equally divided among all my Children, Also lend to my beloved Wife one Negroe Woman named Edy during her life her widowhood & at her death to be Sold and equally divided among my daughters Elizabeth Durham & Rebecca Durham & Susey Durham, also I lend to my well beloved wife all my land during her life her widowhood and at her death to be equally divided among my Sons Aron durham and John Durham & Thomas Durham and Mathew Durham and Iley I. The Orange County, North Carolins will of Susannah's husband Thomas Durham was dated 22 May 1803 and provd August 1803 (Will book D, Pages 103, 104) stated that she was to receive all of the household furniture and movable property. Upon her death everything was to be sold and equally divided among the children. Upon her death....to be sold and equally divided among the daughters Elizabeth Durham & Rebecca Durham & Susey Durham. The land was to be divided among the sons Aaron Durham, and John durham & Thomas Durham and Matthew Durham and Iley I. Durham & Ezra Durham. He appointed his well beloved friends William Durham and Thomas Cate as the executors of the will. Articles of agreement between the sisters & brothers (viz) Elizabeth Faucett & Rebecca Faucett wherein they gave up all rights and title to land to brothers aaron, John, Thomas, Ilai and Ezra Duham, was dated 28 January 1818. The agreement was signed by the husbands Samuel Faucett and Richard Faucett and witnessed by John Durham. The brothers, in turn, signed an agreement with Elizabeth and Rebecca Faucett giving up property left to their youngest sister by her fathers will which she dying without any lawful heir or Will. The agreement was signed by brothers Aaron, John, Thomas,Ilai, and Ezra Durham on 28 January 1818 and recorded in May Term 1818.
