Henry Durham is listed in Patrick County, Va in the 1830 and 1840 census. He later moves to Surry County around 1846-1849. In the 1840 census for Patrick County, VA, Henry Durham is only 3 households away from "Mary (Polly) Hart", the wife of Cornelius Hart and the youngest daughter of Gregory Durham and Elizabeth Shelton.

In the 1870 census for Surry County, NC - Paulina Jane (Chandler) Durham (Henry Durham's widowed wife) is head of household and has an elderly lady "Sarah Durham - age 85" living with her. This is the same "Sally (Sarah) Durham who is living with Nancy Durham in the 1850 census for Surry County, NC.

FDK WEBB is listed as a "witness" to the marriage of Henry Durham and Paulina Jane Chandler on September 18, 1839 in Stokes County, NC. FDK WEBB is also listed as a "witness" to the marriage of Elizabeth Durham and James Nichelson in Stokes County, NC. This Elizabeth Durham, I believe to be the daughter of Archibald Durham and Nancy Vaughn. FDK WEBB is also listed as "witness" to the marriages of Lucinda Chandler and Lewis Bowman on 21 June 1840 and Priscilla Chandler and Obadiah Glasgow on 26 June 1840 in Stokes County, NC. Paulina Jane, Priscilla and Lucinda, along with Judith "Judy" Chandler are listed as daughters of Mary Chandler in the Will of Thomas Beasley in September of 1835 in Patrick County, Virginia.

This indenture made & entered into this 3d day of July 1840 between Henry Durham of the county of Patrick and State of Virginia of the first part, Robert Clark of the second part and Thomas M. Clark of the third, A. Staples of the fourth part & Alexander A. Moore of the fifth part witnesseth that the said Henry Durham for and in consideration of the sum of one dollar to him in hand paid by the said Robert Clark, but more especially to secure unto the said Thomas M. Clark the sum of one hundred fifty dollars & fifty seven cents bearing date 1st July 1840 and one day after date said A. Staples one bond of twelve dollars due 25 December 1839 unto Alex A. Moore one bond of twelve dollars due 25 December 1838, which bond was given doth give grant bargain sell and confirm unto the said Robert Clark his heirs or asigns the following land and property to wit one fourth paid of two tracts of land left by Thomas Beasly to Mary Chandler her life, then to her four children, also the following property, 1 bed of furniture 2 jugs 4 chairs 2 coffee pots 2 buckets, 6 plates 2 dishes 6 cups 2 saucers 1 set knives 2 forks 1 hed of Carpenter’s tools 1 broad axe 1 pole axe 2 pares 1 chest 1 dressing table 1 hog and all the rest of the homestead and kitchen furniture. To have and whole the said land and property to him the said Robert Clark his heirs and asigns forever. And the Henry Durham for himself his heirs and asigns warrant & defend a good and perfect right and title to the said land and property to him the said Robert Clark his heirs or asigns. Interest nevertheless that the said Robert Clark shall permit the said Durham to remain in possession and use of the aforesaid property until the 1st day of January mint and even thereafter until the said Thomas Clark, A. Staples and Alex A. Moore shall direct him the said Robert Clark to sell the said land & property then upon the said Robert Clark being so directed he shall proceed to sell at public auction at the house of said Durham the aforesaid property & at the house of Mary Chandler proceed to sell the entire interest in the aforesaid land by previously advertising at Patrick C. Hones at least two days thereto the land & property in so much thereof as will be sufficient to pay the said debts with legal interest thereon & the cost of making this Indenture and surplus if any restore to said Durham. In witness whereof the parties have hereunto set their hand and affixed their seals the day & year above written.

This indenture made & entered into this 5th day of May in the year of our lord 1843 between Henry Durham and Jane his wife of the County of Patrick and the State of Virginia of the one part and Thomas M. Clark of the same County & State of the other part, witnesseth that the said Henry Durham and Jane his wife for and in consideration of the sum of two hundred and ten dollars to them in hand paid by the said Thomas M. Clark the receipt whereof is hereby acknowledged hat given, granted, transferred delivered, & confirmed unto the said Thomas M. Clark and his heirs all the right title & interest which they the said Henry Durham & Jane his wife formerly Jane Chandler had acquired or may hereafter acquire in the estate both real & personal of Thomas Beasly dec’d by virtue of the divisions to said Jane in said Thomas Beasley’s will to have & to hold the said interest or share in the land aforesaid unto the said Thomas M. Clark and his heirs forever and the said Henry Durham & Jane Durham his wife aforesaid doth for themselves their heirs executors of administrators warrant and forever defend unto the said Tho M. This indenture made the second day of November in the year of our lord one thousand Eight hundred and Sixty four between Thomas F. Prather of the County of Surry and State of North Carolina of the one part and Henry Durham of the County of Surry and State of North Carolina of the other part. Witnessth that the said Thomas F. Prather for and in consideration of the sum of Three Hundred Dollars to him in hand paid by the said Henry Durham the receipt whereof the said Thomas F. Prather doth hereby acknowledge hath given granted bargained and sold assign & confirmed and by these presents do give grant bargain and sell assign and confirm unto the said Henry Durham his hiers and assigns forever all that tract piece of parcel of land situate lying and being in the County of Surry in or near Mount Airy bounded as follows (wit) Beginning at a stake corner of the Tobacco factory lot of Banner & Hollinsworth runs South forty one & a half degrees at said line & at the line of W. M. Banner lot five chains & fifty five links to a stake W. M. Banners corner South thirty four degrees west two chains & nine links to sourwood stump North forty two degrees west three chains & thrity two links to a stake South fifty three & a half degrees west four chains & six links to a stake in R. S. Gilmer's line of a strip of land he purchased of Wm Rawley North forty three & a half degrees west two chains & fifty links to Gilmer's line to a stake corner of R. S. Gilmer's North fifty three and a half degrees East four chains & seven links to a stake North fifty five degrees East seventy eight links to a stake then North thirty four degrees East one chain & twenty seven links to the beginning containing two acres and one tenth be the same more or less and also all the woods ways waters water courses, and all and every there appertenances thereto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents issues and profits of the aforesaid lands and premises and every part thereof and all the Estate Right Title interest claim property and demand whatsoever of the said T. Prather to Henry Durham is this day 22nd of September 1869 proved and exhibited before the undersigned Judge of Probate for said County and it is proved by the oath and examination of Joseph Hollinsworth that Elisha Banner the subscribing witness thereto is dead and it is further proved by the oath and examination of Joseph Hollinsworth that he is well acquainted with the hand writing of said Elisha Banner having often seen him write and having often received letters from him and that the name of the said Elisha Banner subscribed as a witness to said deed is in the proper hand writing of the said Elisha Banner, therefore set the said deed with this certificate be registered.

J. D. Creed is listed as "Adminstrator" to Henry DURHAM on the "Index to Inventories, Accounts and Settlements" on December 6, 1909 --- Surry County, N. C., (Microfilm # B/4a located at the Surry County Community College.)

Henry DURHAM and Paulina Jane CHANDLER were married on 18 Sep 1839 in Stokes County, North Carolina.8 Bondsman: John W. Dunkin, Witness: Fdk Webb Paulina Jane CHANDLER (daughter of Thomas BEASLEY and Mary HARRIS) was born in Jan 1818 in North Carolina.1,3,4,9,10 She died on 20 Jul 1901 in Mount Airy, Surry County, North Carolina.7 The booklet "Its Early Years 1829 - 1900" by Ruth M. Minick, 1975, pages 37-40 state that Jane Durham was age 84 years, 6 months, and 5 days old when she died. The 1900 census for Surry County, NC show Jane Durham to be 83 years old, which is consistant with the death age of Jane Durham.

Paulina "Jane" Chandler is mentioned in the Will of Thomas Beasley (Beazley) as the daughter of Mary Chandler. "Chandler" may be the decease name of Mary's husband?? It is unsure how Mary Chandler is connected to Thomas Beasley, but records do show he was charged at one time of bigamy.

The deed between Henry Durham and wife Jane (Chandler) of the first part and Thomas M. Clark of the second part, made on May 5th, 1843 in Patrick County, VA, states that Jane Chandler was the recepient of land handed down to her by the Will of Thomas Beasley, through her mother Mary Chandler.

In 1820 Thomas Beasley is indexed as Thomas Brasley and living in Patrick Co.Va. He is 45+ and he has in the household: one male >10, 2 males 16-26, 1 female 10-16, 2 females 16 - 26 and one female 26-40.

In 1830 he is indexed as Thomas Bensely (the census clearly reads Beasley) in Patrick Co Va. He is age 50-60 and he has 2 males ages 15-20 and 20-30. He also has a female age 20-30. Hardin Beasley is in a separate household with a wife, 2 sons and 3 daughters

I Thomas Beasly of Patrick County & State of Virginia do hereby make my last Will and Testament in minimum and form following that is to say.

1st I desire that all the perishable part of my estate be immediately sold after my decease except such as herein after mentioned. And out of the moneys arising therefrom all my just debts and funeral expenses be paid. Should the perishable parts of my property that I have directed to be sold prove insufficient for the above purposes there I desire that my Executor herein after m______?? may sell of my property of sufficient value to satisfy my just debts as that remains unpaid.

2ndly after this payment of all my just debts and funeral expenses I give my wife, Hannah Beasly one bed and furniture three head of cattle and feed for them this winter, one of my young mares, one negro woman by the name of Irish and her support farm, the southern tract of land where I now live and to remain in the mansion house where I now live, during her life and at her death the seed property to be sold and the money to be equally divided between all her children.

3rd I give my daughter, Polly Beasly two hundred dollars in money to be left in the hands of Thomas I. Tantum to be paid to her as she may stand in kneed (need) of it, one bed and furniture and cow to have possessions of it on the day of sale.

4th I give to my son Shadrack Beasly ten shillings.

5th I give to my son Shadrack Beasly’s children two hundred dollars in money to be left in the hands of Thomas I. Tatum to be equally divided between them when they became of age.

6th I give to my son Hardin Beasly one tract of land containing thirty seven ¾ acres known by the name of the Sam’l Hanby Sandlim tract and one ??_entry?? Joining the same containing ninety four acres and six hundred dollars in money to him and his heirs forever.

7th I give to my daughter Hannah the wife of Seaton Chandler the tract of land she now lives on known by the name of the Bowman tract containing one hundred and seventy four acres more or less and one negro girl by the name of Martha and three head of cattle to her & her heirs forever.

8th I give to my daughter Catherine the wife of Benjamin Harris ten shillings.

9th ly I give to my son Thomas Beasly one tract of land containing two hundred and sixty eight acres known by the name of the ?Hudson Branch, ten head of cattle, one yoke of oxen and cart, four beds and furniture, twenty head of hogs, all my household and kitchen furniture not heretofore dispensed of, six negros (viz) Hannah, Edmond, Hampton, Mahala, Zach and Mary at my plantations, tools belonging to this place, two head of horses, choice of my stock, twenty barrels of corn, five hundred lbs of bacon, and any small ?_______ supposed to hold fifty five gallons to him and his heirs forever.

10th ly I give to Mary Chandler one tract of land containing forty eight acres lying mostly on the southwest side of Little Dan River - known by the name of the Shadrack Gowing tract and one tract of land containing seventy five acres lying on the west side of Little Dan River, one of my young mares, one cow, ten barrels of corn during her life and at her death the said tracts of land and other property that I give her to be sold and the money arising from the same to be equally divided between her four youngest daughters, (viz) Jane, Lucinda, Priscilla & Judy and I give Mary Chandler one hundred dollars to be left in the hands of Thomas I. Tantum to be paid to her as she may stand in kneed (need) of it and if any of said money not made use of by the said Mary Chandler to be divided between her four youngest daughters above named and if the said Mary Chandler ever marrys or suffers, Anderson Dryden to settle in any part of the aforesaid lands it is reverted back, unto the hands of my Executor and to be sold and the money arising from the same be equally divided between her four youngest daughters above named.

11th ly Five negros, (viz) Sally, Peter, Randle, Amy & Sary & all the rest of my estate both real and personal of what nature or kind so ever it may be not here to fore particularly disposed of ?____ may be sold and the money arising from the same to be equally divided between my wife Hannah Beasly, my son Hardin Beasly, my daughter Hannah the wife of Seaton Chandler and my son Thomas Beasly, except one hundred dollars to be left in the hands of Thomas I Tatum for Mary Chandler as before mentioned, my wife Hannah Beasly part to be left in the hands of Thomas I Tatum & to be paid to her as she may stand in kneed (need) of the same - and at her death of any of ?feed money not made use of by here to be equally divided between my son Hardin Beasly, my daughter Hannah the wife of Seaton Chandler, and my son Thomas Beasly.

And lastly I do hereby constitute and appoint my friend Thomas I Tatum Executor of this my last Will and Testament hereby revoking all other or former wills or testaments by me heretofore made in witness.

The Last Will and Testament of Thomas Beasly, des’ was proved in court by the oaths of the witnesses thereto & is ordered, to be recorded and was ?_______ deliver of Thomas Tatum the Executor where as named who made oath thereto and together with A. Staples, Clerk, Penn G. King, Richard Thomas and Henry Hines his securities order unto and acknowledged at hand on the penalty of ==25000???(maybe 25,000 pounds?). And conditioned as the law directs certificate as granted here for claiming probate of said Will in due process??

From Byron K Durham to Nancy Chandler:

The bigamy charge against Thomas Beasley comes from a book I found at the Library of Virginia entitled "Miscellaneous Records of Patrick County, VA (F-232) Section III - page 5:

(26 April 1811) Thomas Beasley, on suspicion of the felonious crime of Biggamy, was led to the bar, pleaded not guilty, and for reasons appearing to the Court the tryal is referred to the last tryal date in May. Beasley gave bail in the amount of $500 with his securities, James S. Gaines and Elihu Ayres.
(30 May 1811) Thomas Beasley and Elizabeth Bellar appeared this day to their recognizance and were discharged of it. The Court being of the opinion that the adjournment of the last examing Court was illegal. The prisoners were therefore discharged out of custody.

Thomas __Tatum, Executor of Thomas Beazly, decesed, Hanna Going, Alias Beazly, Thomas Going alias Beazly, Hardin Going alieas Beazly, Seaton Chandler and Hannah Chandler his wife, formerly Hannah Going alias Beazly, Benjamin Harris and Catherine Harris his wife, formerly Catherine Going alias Beazly, Polly Beazly, Mary Chandler, James (or Jane) Chandler, Lucinda Chandler, Priscilla Chandler and Judith Chandler. Spa in Chancery - No Spa.

Nancy Chandler's comments on these last 2 records.
Thomas Beasley apparently had 3 long term relationships with women during his life. The 1st is with Hannah Going with whom he had 6 children who are named in his will. The 2nd is Elizabeth Bellar with whom he is accused of bigamy, but the charge got dropped. She is not named in the will. The 3rd is Mary Chandler with whom he had 4 daughters and who are named in his will.
Note that it is an Elizabeth Beasley who is suing the executor of Thomas Beasley's estate and all the people named in his will, a year after it is filed. It was an Elizabeth Bellar who was accused of bigamy with Thomas Beasley in 1811. I strongly suspect that this is the same Elizabeth who is calling herself Elizabeth Beasley and suing everyone who is named in the will. She refers to Hannah Beasley as Hannah Going alias Beasley and calls all of Hannah's children Going alias Beasley. I think she was implying that there was no legal marriage between Hannah Going and Thomas Beasley and that she, Elizabeth was the real wife of Thomas Beasley and entitled to a share of his estate.
